HB 445 is a deeply flawed bill that threatens the future of Alabama’s hemp industry—and it’s moving fast.

This bill has already passed the House and was heard in Senate committee. If it continues advancing without changes, it could devastate small businesses, limit consumer access, and give unfair advantages to a handful of liquor retailers.

Here’s what HB 445 would do:

  • Ban direct-to-consumer (DTC) sales, including online, delivery, and shipping of all hemp products
  • Restrict low-dose hemp beverages to liquor stores and standalone hemp shops, excluding them from beer and wine retail channels
  • Limit topical sales to pharmacies or 21+ restricted stores—even for non-intoxicating CBD lotions
  • Mandate individually wrapped gummies, creating unnecessary environmental waste
  • Impose high fees and excessive red tape that will crush small businesses and favor large, out-of-state players

 

This bill creates a narrow, privileged marketplace for a select few—while stripping away access for consumers and handcuffing responsible, local hemp companies.
