Bad Bills in WA

State Alert

On the heels of our prior efforts in Oregon, legislation in neighboring Washington State poses an existential threat to the retail sale of full-spectrum (and perhaps broad-spectrum) hemp extracts. SB 5547/HB 1668 were introduced as efforts to ensure that intoxicating compounds such as delta-8 THC are sold only through adult-use channels. But the bills would restrict to Washington’s marijuana market any hemp product that contains more than 0.5 mg per serving/2 mg per package of any cannabinoid that “may be impairing.” This would sweep in non-intoxicating levels of THC, as well as potentially other non-intoxicating cannabinoids, and would eliminate many popular non-intoxicating hemp products from the general marketplace. The bills also prohibit the manufacture and sale of artificial cannabinoids, which could include non-intoxicating products like CBN.
