Help Amend HB5150, Fight Overly Restrictive Requirements for Beverages and Hemp Products

HB 5150 would repeal the current law that allows tinctures to have 25mg of THC per container, would limit hemp products to 3mg THC per container and two containers per package, and would prohibit most beverages. The version of the bill passed by the House would allow some non-alcoholic beverages with THC to be sold, but the beverages must be sold in a dispensary, hybrid retail store, or package liquor store, must contain no more than 3mg THC, must contain 12 fluid ounces, and could not be sold in more than a 2-pack.

These confusing restrictions will hurt the hemp products industry and reduce economic opportunities for hemp farmers and small businesses. In particular, there are few, if any, hemp-derived THC beverages that could meet HB 5150’s requirements. The bill should therefore be amended to restore the current law’s protections for hemp-derived tablets and tinctures and to allow beverages with up to 5mg of THC to be sold in containers of 7 fluid ounces or larger.
