The Illinois Department of Agriculture proposed amendments to the state’s Industrial Hemp Act that would wreak havoc for hemp products. Under the proposed rules, hemp that has not been tested, including unharvested hemp crops, would be deemed cannabis. Further, a license would always be required when transporting hemp, effectively meaning that consumers would need a license to buy hemp products and take them home. These proposed rules are poorly drafted and confusing and would have unintended consequences.
