Hemp Bill Updates in Florida, Texas, Arizona, Idaho, South Carolina and Tennessee

We’re tracking legislative moves in Texas, Florida, Arizona, Idaho, South Carolina and Tennessee that have varying impacts on hemp businesses and consumers.

Florida – Amendments Needed to Protect DTC

  • HB 7027 protects hemp THC product sales but needs amendments to safeguard direct-to-consumer sales, standardize THC limits, and establish reasonable packaging rules. Urge lawmakers to amend this bill!
  • HB 7029 proposes a 60% tax on hemp products, with separate beverage taxes. This could significantly impact the industry.

Texas – SB3 and HB 28 Hearing Monday

  • SB 3 would ban all cannabinoids except CBD and CBG, eliminating 90-95% of hemp products. Oppose this bill!
  • HB 28 would criminalize direct-to-consumer hemp sales. Oppose this bill!

Arizona – Beverage Bill Could Ban DTC 

  • SB 1556 would regulate hemp beverages like alcohol, potentially banning e-commerce sales. Oppose this bill!

Idaho – Ban Bill Introduced 

  • HB 478 seeks to ban hemp consumables and require licenses for hemp retailers. Oppose this bill!

South Carolina – HB 3924 Positively Amended

  • HB 3924 has been amended to no longer contain THC mg limits, nor does it block Delta-8 and other semi-synthetics. Support this bill!

Tennessee – DTC Ban Considered 

  • HB 1376 would move hemp regulation to the Alcoholic Beverage Commission and ban direct-to-consumer sales. Vote scheduled for April 10. Oppose this bill!

Florida

In Florida, HAT 25-01 explicitly protects the sale of hemp consumable THC products and ensures that such products are safe and not available to children.  While the bill is a significant step forward from the hemp-killing SB 438, there are portions of the bill that raise concerns.  Particularly, we would like to amend the bill to ensure protection of direct-to-consumer sales, standardize THC milligram limits among hemp beverages and edibles, and enact reasonable labeling and packaging requirements. The Roundtable provided comments on this bill to the Chair of the Florida House’s Housing, Agriculture, & Tourism Subcommittee and outlined our suggested changes. The Roundtable’s lobbyist met with the Chair, and she was amenable to a variety of revisions in the bill, including clarifying DTC permit requirements.

Florida is also debating HB 7029, which would levy a 60% tax on the wholesale price of all hemp consumable products, except for beverages.  This tax must be paid by all retailers, manufacturers, and wholesalers.  Retailers, manufacturers, and wholesalers must all pay a tax on hemp beverages of $2.25 per gallon when sold in bulk.  If beverages are sold in containers of 1 gallon or less, the tax shall be 29 cents per pint or fraction thereof.  Sponsors indicate that this tax is equivalent to the current excise tax for beer and wine.

Texas

Texas’ SB 3 is scheduled for a committee hearing in the House on Monday, April 7.  As we’ve shared previouslySB 3 would ban all cannabinoids except CBD and CBG isolates, effectively eliminating 90-95% of the hemp product marketplace.  In addition, Texas’ HB 28 would criminalize direct-to-consumer distribution of hemp products.  HB 28 is the product of the Texas Package Stores Association and creates a carve out for beverages with hemp-derived THC.  However, it transfers the administration authority to the Texas Alcoholic Beverage Commission and places THC beverages in to the same three-tiered system as liquor.

Arizona

In Arizona, SB 1556 is starting to receive hearings in House committee.  This bill would regulate adult hemp beverages as alcohol, restricting them to premises or stores licensed to sell alcohol. An adult hemp beverage is any beverage that contains less than 30mg of total THC per liter.  Our reading is that, due to the alcohol license requirements, e-commerce sales could be prohibited.

Idaho

In Idaho, HB 478 was recently introduced.  This bill would ban the sale of hemp consumables in Idaho and would also require retail locations that sell hemp products to obtain an annually-renewed license from Idaho’s Department of Agriculture.

South Carolina

South Carolina’s HB 3924 has passed through committee and is headed to the floor of the House for a vote.  While we have previously alerted you to this bill, the language has been improved significantly during the committee process.  The bill no longer no longer sets limits on the amount of THC in hemp products.  As currently written, the bill only restricts access to those 21 and older and requires hemp products to be held behind the counter or in a locked display.

Tennessee

As an updated to a previous alert in Tennessee, HB1376 is scheduled for a vote on the House floor on April 10.  This bill proposes that the hemp industry be regulated by the Tennessee Alcoholic Beverage Commission and limits the level of Delta-9 permitted in a product to 0.1%. Direct-to-consumer sales of hemp products, including beverages, would also be prohibited.
