Updates in Arizona, Florida, Massachusetts, New York, North Carolina, and Ohio

Arizona
We’re starting with good news. In Arizona, a coalition of Hemp Supporters killed the marijuana industry’s final effort to enact a hemp ban this year. We congratulate our friends at the Hemp Industry Trade Association of Arizona for their important work throughout the legislative session, during which they defeated four hemp ban bills!
Florida
In Florida, Governor Ron DeSantis vetoed SB 1698, the anti-hemp bill that would have banned delta-8 and similar products and set total THC limits of 5mg/serving and 50mg/package. Read our General Counsel’s statement here.
Massachusetts
As we feared, the Massachusetts Department of Public Health recently issued guidance that it is illegal to add CBD or THC to food or beverages. The guidance confirms, however, that hemp-derived ingredients may be added to cosmetics. Until a law protecting all hemp products can be passed, we expect there will be a chill cast across the Massachusetts’ hemp products industry.
North Carolina
North Carolina H563 remains in Senate committee. The House’s version limits ingestible products to 3mg per serving of delta-9, delta-7, delta-8, or delta-10 THC in the aggregate. However, a version adopted by two Senate committees limit non-liquid ingestible products to 25mg per serving of delta-9, delta-7, delta-8, or delta-10 THC in the aggregate and liquid ingestible products to 10mg per serving in the aggregate. The competing versions appear headed for a conference fight.
We urge our North Carolina Hemp Supporters to use our State Action Center to urge lawmakers to support the Senate version.
New York
It looks like New York S9487 was not taken up with the omnibus bill discussed last week.
There’s still time for New York Hemp Supporters to use our State Action Center to urge lawmakers to support this progressive bill, which would increase the current THC limit for beverages to 5mg THC.
Ohio
Finally, we’re hearing that Ohio lawmakers want to pass a behind-the-counter requirement for hemp products, including beverages. Our lobbyist is urging lawmakers to consider Minnesota’s model, which creates an exception for hemp beverages, which do not neatly fit behind the typical counter. Watch this space, as we’ll have more to share soon.
